EU law allows Member States to establish thresholds of up to 5% of all votes cast as a condition for any party to be allocated seats in the European Parliament. In 14 Member States, there are formal thresholds of this kind. (Logically, in Member States or regions with a relatively low number of MEPs, there is a de facto threshold, even if no formal one, above 5%.)
